Driving license : While driving on the road, we often see that the traffic police issue challans for violating traffic rules.
Sometimes, in some cases, the driver’s driving license is even suspended or revoked.
But a recent landmark judgment by the Calcutta High Court has made the matter very clear the court has said that the traffic police have no power to cancel or suspend driving licenses.
They can only temporarily confiscate the license , and that too in specific circumstances.
What is the court’s decision?
On July 24, 2025, the Calcutta High Court delivered an important verdict. The court said that only the licensing authority ( RTO ) has the authority to cancel or suspend a driving license.
According to Section 206(4) of the Motor Vehicles Act 1988 , the police can temporarily confiscate a license only if the driver:
- Drink and drive
- Drive dangerously or recklessly
- Or drive too fast
Justice Parthasarathy Chatterjee said that even if someone breaks a traffic law, the police must have a strong legal reason to confiscate the license, and the action must be in accordance with the law .

Case description

The case involved a Kolkata-based lawyer named Subhrangsu Panda. He was stopped by the traffic police for speeding.
The lawyer alleged that the police personnel confiscated his driving license and demanded cash instead of an online challan .
After this incident, he filed a petition in court.
After investigation, the court dismissed all charges against the lawyer and issued a warning to the police officer concerned . The court also ordered that all traffic officers be given proper training on the Motor Vehicle Act .
What does the law say?
According to the law ( Section 2(20) of the Motor Vehicles Act 1988 ) , only the Licensing Authority (RTO) can cancel or suspend a driving license .
The traffic police can only temporarily confiscate the license, and then it has to be sent to the relevant authority for further action.
This decision has now made it very clear that no police officer can revoke or suspend a driving license on their own.

- All traffic officers should be given legal training .
